User License Agreement for the Email Address panda@sunfyre.com This agreement is between Jason Tweed, owner of the copyrighted email address panda@sunfyre.com and lease holder of the domain name sunfyre.com, and any other party who sends messages to panda@sunfyre.com. For purposes of this agreement, Jason Tweed will be known as "Account Owner" or "Mr. Tweed", and is identified as Jason Tweed residing at 621 Byram Street in Reading Pennsylvania, 19606, United States of America. Jason Tweed may be contacted at 1-610-779-2460 by telephone from within the U.S. and Canada with questions about this agreement. For purposes of this agreement anyone sending messages to panda@sunfyre.com shall be known as "Solicitor" and includes anyone who attempts to contact panda@sunfyre.com for any reason. Examples of a "Solicitor" include but are not limited to private individuals, companies, non-profit organizations, third-party contractors, marketing professionals and companies, and all other entities. For the purposes of this agreement panda@sunfyre.com shall be known as the "Email Address" or "Panda" and shall be identified as the copyrighted email address panda@sunfyre.com and all variations of upper and lower case characters included in panda@sunfyre.com in that order. (e.i. Panda@SunFyre.com or PANDA@SUNFYRE.COM ) Any Solicitor contacting or attempting to contact stated Email Address agrees, in so-doing, to pay the Account Owner not less than 50.00 United States dollars within thirty (30) calendar days from attempt. Solicitor agrees: Payment entitles solicitor to rights to contact or attempt contact the Email Address for a period of 24 hours from initial attempt or 24 total attempts and/or successful contact, whichever is sooner. These contact rights are not transferable to any other entity or individual. Solicitor agrees: Attempts at contacting or successful contacts to Email Address after 24 hours or 24 attempts will result in an additional payment required. The additional payment required shall be not less then 50.00 United States dollars. This additional payment shall also be due to Account Owner within thirty (30) calendar days. Solicitor agrees: If any payment due to Account Owner is not paid within thirty (30) calendar days, a penalty of not less than 100% will be added to the balance due. Every thirty (30) calendar days thereafter and additional penalty will be assessed of not less than 100% of the balance due. Solicitor agrees: To pay any documented expenses incurred by Mr. Tweed in the normal process of collecting balances overdue by thirty (30) calendar days including, but not limited to, attorney fees, collection company fees, postage, certified mail, telephone calls within and outside the United States. Solicitor agrees: Account Owner is not required to contact Solicitor to begin this agreement. Solicitor agrees to remit payment by mail to:
Account Owner reserves the right to terminate this agreement at any time in writing. This agreement originated on January 14, 2004 in Reading Pennsylvania USA.
